Regulations
Spain treats a mobile home as equivalent to a prefabricated house for planning purposes. The Supreme Court (Tribunal Supremo), in ruling 1917/2024 of 5 December (ECLI:ES:TS:2024:6022), held that placing a mobile home requires a municipal planning licence under article 11.4.c) of the Land and Urban Rehabilitation Law (Real Decreto Legislativo 7/2015), which requires express authorisation for "the placement of prefabricated houses and similar installations, whether temporary or permanent" — and that a campsite's own tourism activity licence does not cover the installation on its own. This is why living in a mobile home permanently in Spain depends on the land, not the unit: on urban or developable land with the right classification, residential use is normally possible with the municipal licence; on suelo rústico (non-developable rural land), residential use is generally restricted or prohibited unless the regional and local plan allows it for a compatible use. The Balearic and Canary Islands apply additional, more restrictive regional rules on top of the national framework. VAT (IVA general) on the purchase is 21%, applied to the transaction value.
